Terms of Service

These Terms of Service (“Terms”) are an agreement between you and BX Precision Engineering (“we”, “us”) governing your use of the Eggspecting mobile application and this website (together, the “Service”). By downloading or using Eggspecting, you agree to these Terms. If you don’t agree, please don’t use the Service.

Important: Eggspecting is a personal pregnancy journal and wellness companion. It is not a medical device and does not provide medical advice, diagnosis, treatment, or predictions. It is not a substitute for professional care. Always consult your healthcare provider with any questions about your pregnancy or health, and call your local emergency number in an emergency.

1. Wellness, not medical care

Eggspecting offers general information and a way to record how you feel. It does not monitor your health or your baby’s health, does not detect or warn of medical conditions, and must never be relied upon for medical decisions. Anything you read or track in the app is for your personal reflection only. Your healthcare provider is always your source of truth.

2. Your account & your data

Eggspecting has no accounts. Your content is stored on your device and, if you choose, in your own iCloud. You are responsible for your device, your iCloud account, and for keeping your own backups or exports. How we handle data is described in our Privacy Policy, which forms part of these Terms.

3. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Eggspecting for your own non-commercial use, in accordance with these Terms and the Apple App Store Terms of Service. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by law.

4. Eggspecting Pro & subscriptions

Core features are free. “Eggspecting Pro” is an optional auto-renewable subscription offered on a monthly or annual basis, and may include a free trial.

Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
You can manage or cancel your subscription in your Apple ID settings (Settings → your name → Subscriptions). Deleting the app does not cancel a subscription.
Prices are shown in the app and may vary by region and over time. Refunds are handled by Apple under the App Store terms.

Emotional-safety features — including the loss and pause experiences — are never placed behind a paywall.

5. Acceptable use

Please use Eggspecting only for its intended personal purpose and in a lawful way. Don’t attempt to disrupt the Service, misuse the partner-sharing feature, or use the app in any way that infringes the rights of others.

6. Intellectual property

The Eggspecting app, its name, its buddies and artwork, its design, and this website are owned by BX Precision Engineering and protected by intellectual-property laws. Your journal content remains yours; these Terms don’t give us any ownership of what you create.

7. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that it will meet your particular needs. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you, and nothing here limits any rights you have as a consumer under applicable law.

8. Limitation of liability

To the fullest extent permitted by law, BX Precision Engineering will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of, or inability to use, the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your non-excludable consumer guarantees.

9. Apple App Store terms

You acknowledge that these Terms are between you and BX Precision Engineering, not Apple, and that Apple is not responsible for the app or its content. Apple has no obligation to provide support for the app. Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the Apple Media Services Terms and Conditions, including the standard Licensed Application End User License Agreement (EULA).

10. Changes

We may update the Service and these Terms from time to time. When we make material changes, we’ll update the “Last updated” date above. Continued use after changes take effect means you accept the revised Terms.

11. Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection laws of the country in which you live.
